Beta Testing Terms

1. What Is the Beta Programme?

Xanivar Labs Pte Ltd ("Xanivar," "we," "us," or "our") is making a pre-release version of the Xanivar platform available to a limited group of users ("Beta Programme"). The Beta Platform is provided exclusively for testing and feedback purposes and is NOT a production-ready service.

"Beta Platform" means xanivar.com (and related domains) in their pre-release state, including any features, tools, APIs, and services designated as "Beta," "Preview," "Early Access," or "Experimental."

2. Eligibility and Beta Access

To participate in the Beta Programme you must:

Be at least 16 years of age (or at least 18 if required by the laws of your country of residence);
Have been invited or approved by Xanivar — access is at Xanivar's sole discretion;
Provide accurate information when creating your Beta Account; and
Agree to these Terms before accessing the Beta Platform.

Beta access is a privilege, not a right. Xanivar may grant, withhold, suspend, or revoke Beta access at any time, for any reason, without notice and without liability.

3. Limited Beta Licence

Subject to your compliance with these Terms, Xanivar grants you a personal, non-exclusive, non-transferable, revocable licence to access and use the Beta Platform solely for: (a) testing functionality; (b) identifying errors and bugs; and (c) providing Feedback to Xanivar.

You may not use the Beta Platform for production or commercial purposes, and you may not allow third parties to access your Beta Account.

4. No Warranties — "As Is"

XANIVAR PROVIDES THE BETA PLATFORM "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, XANIVAR EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, SECURITY, ACCURACY, AND UNINTERRUPTED AVAILABILITY. YOU USE THE BETA PLATFORM ENTIRELY AT YOUR OWN RISK.

For EU and UK consumers, mandatory statutory rights that cannot be excluded by contract are preserved.

5. Data Loss — No Data Guarantee

THE BETA PLATFORM IS AN EXPERIMENTAL ENVIRONMENT.

Your data — including profile information, content, messages, media, purchases, and Creator earnings — MAY BE LOST, CORRUPTED, DELETED, OR RESET AT ANY TIME, WITH OR WITHOUT NOTICE. Xanivar does not guarantee that any Beta data will be retained or migrated to production. Do not store data you cannot afford to lose on the Beta Platform.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

(A) XANIVAR'S TOTAL AGGREGATE LIABILITY TO YOU IS LIMITED TO SGD 50 (FIFTY SINGAPORE DOLLARS), REGARDLESS OF THE CAUSE OF ACTION.

(B) XANIVAR IS NOT LIABLE FOR ANY LOSS OF DATA, CONTENT, OR REVENUE; LOSS OF PROFITS OR BUSINESS OPPORTUNITY; OR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Nothing here limits Xanivar's liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under mandatory applicable law.

7. Known and Unknown Beta Risks

You acknowledge that the Beta Platform may contain bugs, defects, and incomplete features including:

Features that do not function as intended;
Unexpected crashes, downtime, or data corruption;
Payment processing errors or transaction failures;
Security vulnerabilities;
Features being added, changed, or removed without notice; and
No guaranteed uptime — there is no SLA during Beta.

8. Payments and Financial Features During Beta

⚠ Important — Payments in Beta

Payment features may operate in TEST MODE by default. Do NOT enter real payment card details unless Xanivar explicitly notifies you that live payment processing is enabled for your Beta Account. Creator earnings, payouts, tips, and subscriptions processed during Beta are subject to reversal or cancellation if Beta data is reset. Xanivar is not responsible for funds lost due to Beta payment processing errors.

9. Confidentiality of Beta

The Beta Platform and your experience as a Beta Tester are confidential. You agree not to:

Disclose, publish, post, tweet, stream, or screenshot Beta features to third parties without Xanivar's consent;
Livestream or record your use of the Beta Platform for public audiences;
Discuss unreleased features, pricing, or roadmap details publicly.

Confidentiality obligations apply during the Beta Period and for one (1) year thereafter.

10. Feedback and Intellectual Property

By providing Feedback (via in-app tools, email, surveys, or calls), you irrevocably assign to Xanivar all right, title, and interest in that Feedback. Xanivar may use, incorporate, and commercialise Feedback without restriction, compensation, or obligation to acknowledge your contribution.

11. Your Obligations as a Beta Tester

As a Beta Tester you agree to:

Use the Beta Platform in good faith for genuine testing;
Report bugs via the in-Platform tool or beta@xanivar.com;
Comply with the Xanivar Acceptable Use Policy and Terms of Service at all times;
Not reverse-engineer, decompile, or exploit the Beta Platform beyond your testing role; and
Not share Beta access credentials or invite others without Xanivar's permission.

12. Beta Period and Termination

The Beta Period ends when Xanivar launches the production platform, terminates your individual Beta access, or ends the Beta Programme entirely — whichever occurs first.

Xanivar may terminate the Beta Programme or your Beta access at any time, for any reason, without notice and without liability. Upon termination, your right to access the Beta Platform ceases immediately. Xanivar may delete your Beta Account and all associated data without notice.

13. Transition to Production Platform

When Xanivar launches production, Xanivar may (but is not obligated to) migrate your Beta Account and data. Xanivar makes no commitment that Beta Accounts, content, purchases, Creator earnings, or any other Beta data will be available on the production platform.

14. Indemnification

You agree to indemnify and hold harmless Xanivar Labs Pte Ltd and its officers, employees, and contractors from any claims, liabilities, and expenses (including legal fees) arising from your use of the Beta Platform in violation of these Terms, your content or conduct, or your breach of confidentiality obligations.

15. Relationship with Main Terms

These Beta Terms supplement Xanivar's Terms of Service, Privacy Policy, and Acceptable Use Policy, all of which remain in full force during Beta. Where these Beta Terms conflict with the main Terms on Beta-specific matters (liability, warranties, data), these Beta Terms prevail.

16. General

Governing Law: Laws of the Republic of Singapore.

No Compensation: Beta participation is voluntary and unpaid. You will not receive compensation, payment, equity, or other consideration for participation or Feedback.

Amendment: Xanivar may update these Beta Terms at any time with 7 days' notice. Continued use of the Beta Platform constitutes acceptance.
